Investor Protection
Who is responsible if I suffer losses after signing up through a sales agent?
Under the Financial Consumer Protection Act, a direct seller of financial products is liable for damages if a sales agent or broker acting on its behalf causes losses to a consumer in the course of business.
However, the direct seller may be exempt from liability if it exercised due care in appointing and supervising the agent or broker and made efforts to prevent the losses. Remember also that sales agents and brokers are in principle prohibited from receiving investment money directly from consumers.
