Your rights

Financial consumer rights

  1. 01

    Right to an explanation

When a product is recommended, you are entitled to an explanation of its key features and risks. (Article 19, Financial Consumer Protection Act)

  2. 02

    Suitability and appropriateness

Financial firms must check your financial situation, experience and objectives and must not recommend unsuitable products. (Articles 17 and 18)

  3. 03

    Right to withdraw

For investment products and certain discretionary or trust contracts specified by law, you may withdraw within 7 days of receiving the contract documents. (Article 46)

  4. 04

    Right to terminate unlawful contracts

If a contract was concluded in breach of sales rules such as the duty to explain, you may request termination within one year of learning of the breach (and within five years of the contract). (Article 47)

  5. 05

    Right to access records

You may request access to records kept by the financial firm for dispute resolution or litigation. (Article 28)

  6. 06

    Right to request dispute mediation

If you have a financial dispute, you may ask the Governor of the Financial Supervisory Service to mediate. The Financial Dispute Mediation Committee at the FSS reviews these cases. When both parties accept a proposal, it has the same effect as a settlement in court. (Articles 33, 36 and 39)

These rights come from the Financial Consumer Protection Act. Whether one applies depends on the product, the contract and whether you are a general financial consumer. Financial Consumer Protection Act (law.go.kr)

Six sales principles

Six sales principles

Six principles that sellers of financial products must follow. This is a short general account of the statute.

  1. 01

    Suitability

When recommending a contract to a general financial consumer, a seller must not recommend a product that is unsuitable in light of the consumer’s finances, experience and purpose. (Article 17)

  2. 02

    Appropriateness

Even in a sale without a recommendation, if a product covered by the statute is not appropriate for the consumer’s finances and related circumstances, the seller must say so and obtain confirmation. (Article 18)

  3. 03

    Duty to explain

When recommending a contract, or when the consumer asks for an explanation, the seller must explain the important points so the consumer can understand them. (Article 19)

  4. 04

    No unfair business conduct

A seller must not use a superior position to force a contract against the consumer’s will, or to demand an unjust guarantee, security or benefit. (Article 20)

  5. 05

    No improper solicitation

A seller must not state an uncertain matter as if it were certain, state something that is not true, or compare products without an objective basis. (Article 21)

  6. 06

    No false or exaggerated advertising

Advertising for a financial product must not contain false or exaggerated content, or a statement that could be taken to mean that losses will be made good or that a profit is guaranteed. (Article 22)

How a complaint moves

How a complaint is handled

A complaint moves through the steps below. How long it takes depends on the matter, so this page does not state an internal deadline.

  1. 01

    Receipt

You may file by the main phone line, email or post. Please give your name, contact details and the point of the complaint. If you hold a product, the product name and when you contracted help us check the facts.

  2. 02

    Checking the facts

We check what you sent against the related records the company keeps. If something is missing, we will ask.

  3. 03

    Reply with the outcome

We reply with the outcome, by phone, email or another way we can reach you, based on the facts we have checked.

  4. 04

    If you disagree

If you disagree with the reply, we will point you to the FSS Financial Consumer Protection Center (1332, no area code in Korea) and to dispute mediation at the Korea Financial Investment Association. Each body’s own rules set its procedure and timing.
